What is Mediation

A practical, informal way of resolving a dispute in which a trained mediator helps to discuss concerns and, if possible, reach a voluntary agreement.

  • The mediator does not take sides or make decision. Instead the mediator encourages communication between the parties to work together and either resolve or manage the conflict.
  • The mediator cannot give legal or professional advice. However, the mediator looks at the problem in different ways.
  • Agreement is reached only when all parties agree.

Benefits of Mediation

Each mediation is unique and the outcomes for any particular situation cannot be predicted, but there are some trends characteristic of mediation.

  • Lower costs than court settlements - mediation is usually less expensive than court litigation and sessions can fit your schedule
  • Customized agreements - Mediation can result in agreements that satisfy all parties more than compromise.
  • Personal involvement - Mediation is a way for people to express their needs and interests in a non-threating manner.
  • Preserve relationships - Mediation agreements that satisfy all parties' interests can help preserve the relationship.
  • Agreements that last - Mediated agreements tend to last over time because all parties have an investment in keeping an agreement they worked out themselves.
